With your order you accept the gen­er­al terms and con­di­tions of Galerie Welz GmbH.
The gen­er­al terms and con­di­tions apply to con­sumers when con­clud­ing a dis­tance con­tract in accor­dance with the Con­sumer Pro­tec­tion Act (KSchG) or Dis­tance and Out­bound Busi­ness Act (FAGG).
Unless express­ly agreed oth­er­wise, our gen­er­al terms and con­di­tions that have been made known to the con­trac­tu­al part­ner apply. You will receive an order con­fir­ma­tion with the terms and con­di­tions by email. Please ensure that you enter your com­plete and cor­rect e‑mail address when plac­ing your order.

Prices:
The prices quot­ed are sub­ject to change and apply until revoked.
The prices quot­ed include the statu­to­ry sales tax.

Busi­ness trans­ac­tion:
Inquiry → Price infor­ma­tion → Order → Invoice → Pay­ment → Ship­ping
There may be over­laps from order to ship­ment, so you can only con­firm “while stocks last”. There is no sales tax for ship­ments to cus­tomers resid­ing out­side the Euro­pean Eco­nom­ic Area (EEA) and com­pa­nies with a valid VAT num­ber. Any import tax­es are borne by the cus­tomer. Price changes and mis­prints reserved.

Ship­ping:
The cus­tomer will be informed of the ship­ping costs with the order con­fir­ma­tion. The dis­patch takes place exclu­sive­ly after pre­pay­ment by bank trans­fer and receipt of pay­ment on our account.

Deliv­ery times:
We will process your order with­in 5 work­ing days. The deliv­ery takes place with suit­able ship­ping ser­vice providers, with a deliv­ery time with­in Europe of up to 10 days for ship­ping over­seas of up to approx. 14 days. In indi­vid­ual cas­es there may be delays.

Pay­ment:
The invoice is due for pay­ment imme­di­ate­ly upon receipt with­out a discount.

Reten­tion of title:
The goods remain the prop­er­ty of Galerie Welz GmbH until they have been paid for in full.

War­ran­ty and applic­a­ble law:
The statu­to­ry war­ran­ty pro­vi­sions apply. Only Aus­tri­an sub­stan­tive law is applic­a­ble to the con­trac­tu­al rela­tion­ship, exclud­ing the ref­er­ence norms of inter­na­tion­al pri­vate law and the UN sales law.

Right of with­draw­al – revo­ca­tion:
You have the right to with­draw from the dis­tance sell­ing con­tract with­in four­teen days with­out giv­ing any rea­son. The can­cel­la­tion peri­od is four­teen days from the day on which you or a third par­ty named by you who is not the car­ri­er has tak­en pos­ses­sion of the goods.

by means of a clear dec­la­ra­tion (e.g. a let­ter sent by post, fax or email) of your deci­sion to with­draw from this con­tract. To meet the can­cel­la­tion dead­line, it is suf­fi­cient for you to send your noti­fi­ca­tion of exer­cis­ing your right of can­cel­la­tion before the can­cel­la­tion peri­od has expired.

Con­se­quences of the with­draw­al:
If you with­draw from this con­tract, we will send you all pay­ments that we have received from you, includ­ing deliv­ery costs (with the excep­tion of the addi­tion­al costs that result from choos­ing a dif­fer­ent type of deliv­ery than the cheap­est stan­dard deliv­ery offered by us have), imme­di­ate­ly and at the lat­est with­in four­teen days from the day on which we received noti­fi­ca­tion of your can­cel­la­tion of this con­tract. For this repay­ment, we will use the same means of pay­ment that you used for the orig­i­nal trans­ac­tion, unless some­thing else was express­ly agreed with you; In no case will you be charged any fees for this repay­ment. We can refuse repay­ment until we have received the goods back or until you have pro­vid­ed evi­dence that you have sent the goods back, whichev­er is ear­li­er. You must return or hand over the goods to us imme­di­ate­ly and in any case no lat­er than four­teen days from the date on which you informed us of the can­cel­la­tion of this con­tract. The dead­line is met if you send the goods before the peri­od of four­teen days has expired. You bear the direct costs of return­ing the goods. You only have to pay for any loss in val­ue of the goods if this loss in val­ue is due to han­dling of the goods that is not nec­es­sary to check the nature, prop­er­ties and func­tion­al­i­ty of the goods.

Ful­fill­ment and juris­dic­tion:
Salzburg is deemed to be the agreed place of per­for­mance for all ser­vices from this con­tract. As far as legal­ly per­mis­si­ble, the juris­dic­tion of the local­ly and mate­ri­al­ly com­pe­tent court for Salzburg is agreed for all legal dis­putes aris­ing from this contract.

Data pro­tec­tion:
All cus­tomer data result­ing from inquiries and orders will under no cir­cum­stances be passed on to third par­ties. The cus­tomer declares his con­sent to receive infor­ma­tion and offers from Galerie Welz to the email address provided.

Online dis­pute set­tle­ment plat­form:
Con­sumers have the oppor­tu­ni­ty to sub­mit com­plaints to the EU’s online dis­pute res­o­lu­tion plat­form: https://ec.europa.eu/consumers/odr . How­ev­er, we declare that we are nei­ther will­ing nor oblig­ed to par­tic­i­pate in a dis­pute set­tle­ment procedure.

Book, art and music pub­lish­ing accord­ing to § 103 Abs. 1 lit. b) Z. 6 GewO 1973 (takeover of works of lit­er­a­ture, visu­al arts and sound art for repro­duc­tion and dis­tri­b­u­tion) accord­ing to § 103 para. 1 lit. b) Z. 7 GewO 1973 and trade (with the excep­tion of the licensed, tied trade) and com­mer­cial agents accord­ing to § 124 Z. 10 GewO 1994, trade accord­ing to § 103 para. 1 lit. b) Z. 1 GewO 1973, restrict­ed to the retail trade with antiques and works of art.
