With your order you accept the general terms and conditions of Galerie Welz GmbH.
The general terms and conditions apply to consumers when concluding a distance contract in accordance with the Consumer Protection Act (KSchG) or Distance and Outbound Business Act (FAGG).
Unless expressly agreed otherwise, our general terms and conditions that have been made known to the contractual partner apply. You will receive an order confirmation with the terms and conditions by email. Please ensure that you enter your complete and correct e‑mail address when placing your order.
Prices:
The prices quoted are subject to change and apply until revoked.
The prices quoted include the statutory sales tax.
Business transaction:
Inquiry → Price information → Order → Invoice → Payment → Shipping
There may be overlaps from order to shipment, so you can only confirm “while stocks last”. There is no sales tax for shipments to customers residing outside the European Economic Area (EEA) and companies with a valid VAT number. Any import taxes are borne by the customer. Price changes and misprints reserved.
Shipping:
The customer will be informed of the shipping costs with the order confirmation. The dispatch takes place exclusively after prepayment by bank transfer and receipt of payment on our account.
Delivery times:
We will process your order within 5 working days. The delivery takes place with suitable shipping service providers, with a delivery time within Europe of up to 10 days for shipping overseas of up to approx. 14 days. In individual cases there may be delays.
Payment:
The invoice is due for payment immediately upon receipt without a discount.
Retention of title:
The goods remain the property of Galerie Welz GmbH until they have been paid for in full.
Warranty and applicable law:
The statutory warranty provisions apply. Only Austrian substantive law is applicable to the contractual relationship, excluding the reference norms of international private law and the UN sales law.
Right of withdrawal – revocation:
You have the right to withdraw from the distance selling contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
Consequences of the withdrawal:
If you withdraw from this contract, we will send you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
Fulfillment and jurisdiction:
Salzburg is deemed to be the agreed place of performance for all services from this contract. As far as legally permissible, the jurisdiction of the locally and materially competent court for Salzburg is agreed for all legal disputes arising from this contract.
Data protection:
All customer data resulting from inquiries and orders will under no circumstances be passed on to third parties. The customer declares his consent to receive information and offers from Galerie Welz to the email address provided.
Online dispute settlement platform:
Consumers have the opportunity to submit complaints to the EU’s online dispute resolution platform: https://ec.europa.eu/consumers/odr . However, we declare that we are neither willing nor obliged to participate in a dispute settlement procedure.
Business licenses:
Book, art and music publishing according to § 103 Abs. 1 lit. b) Z. 6 GewO 1973 (takeover of works of literature, visual arts and sound art for reproduction and distribution) according to § 103 para. 1 lit. b) Z. 7 GewO 1973 and trade (with the exception of the licensed, tied trade) and commercial agents according to § 124 Z. 10 GewO 1994, trade according to § 103 para. 1 lit. b) Z. 1 GewO 1973, restricted to the retail trade with antiques and works of art.
